Terms of Use (ToU)

Welcome to Adopt'Animaux. By creating an account or browsing the App, you (the User) enter into a contract with M&G Group (the Company). These rules exist to protect the community and ensure the unconditional respect of animal welfare.

Using the App constitutes legal acceptance of these terms. If you do not agree with any of these common-sense rules, you must not use our platform.

1. Our Exact Role (Host and Aggregator)

Adopt'Animaux is a digital matchmaking tool. We provide the technology allowing an adopter to find a shelter, or a pet owner to find a trainer via an interactive map.

The App also aggregates listings from external partner sources. These listings are clearly identified and redirect to the original sites. We exercise no editorial control over the content of these third-party sites and disclaim any liability for their accuracy, legality, or availability.

2. Your Account, Your Responsibilities

You certify that you are at least 18 years old. You must provide real and verifiable information about yourself. Fake profiles, identity theft, or joke accounts will result in immediate ban.

You are responsible for the security of your password. Any action taken from your account (a message sent, a listing posted, a review left, a danger alert reported) is legally considered yours.

Creating multiple free accounts to circumvent future Pro listing limits is a direct violation of these ToU.

3. Zero Tolerance (Red Lines)

Adopt'Animaux is a space of kindness. You will be permanently banned, without notice and without appeal, if you:

  • Advocate animal cruelty, or offer animals linked to fighting or trafficking.
  • Attempt to sell protected species, illegal exotic animals, or fraudulently imported animals (foreign networks).
  • Are aggressive, insulting, obscene, or threatening towards another member via our messaging, the social Feed, or the review system.
  • Post false danger alerts on the Walk Map with the intent to harm.
  • Use the app to sell anything other than what is explicitly authorised (e.g. selling material goods instead of offering pet sitting).
  • Practise 'Scraping' (automated extraction by bots of our profile or listing data).

4. The Content You Publish

The texts and photos of your listings, Feed posts, and reviews belong to you. By publishing them on Adopt'Animaux, you grant us a licence (free and worldwide) to display them in the app, technically adapt them to different screens, and potentially use them to promote the platform.

You guarantee that the photos belong to you (no photos stolen from the internet) and that they depict the actual animal or service offered.

We reserve the right to unpublish, of our own accord, any listing, post, or review that appears dubious or contrary to the spirit of the platform, without having to justify ourselves.

7. French Animal Legal Code

For Sellers / Breeders / Donors: You MUST comply with the French Rural Code. Mandatory mention of identification (I-CAD), respect of the minimum age of transfer (8 weeks for dogs/cats), and clear registration of the SIREN number if you are a professional or if you sell more than one litter per year. Any breach exposes you to heavy fines from the authorities.

For Adopters / Buyers: You have a duty of diligence. Visit the animal's living conditions, demand to see veterinary certificates and the mother of the litter. Report any seller suspected of being a puppy mill using the 'Report' button.

Certificate of commitment: In accordance with the 2022 French law, a certificate of commitment and knowledge must be signed 7 days before the acquisition of an animal. It is your responsibility to comply with this legal framework.

8. Our Intellectual Property

The app's computer code, walk map algorithm, logos, the Adopt'Animaux name, and the UI/UX design are the exclusive property of M&G Group. Copying, reverse-engineering, or using them without written authorisation will result in counterfeiting proceedings.

9. No Medical or Behavioural Guarantee

We cannot guarantee that the animal you adopt will be in perfect health for life, nor that the dog walker you hire won't be late for their appointment. These risks are inherent to human and commercial relationships between individuals. Using our platform constitutes acceptance of this limitation of our role as host.

10. Limits of Our Liability

To the maximum extent permitted by law, M&G Group shall not be liable for indirect damages, financial losses, or physical or moral harm resulting from a real-life meeting arising from the app, a scam perpetrated by a third party, an inaccurate danger report on the map, erroneous information on an aggregated listing from a third-party site, or a temporary technical failure of our servers. Our total financial liability to you shall not exceed the amount you paid us to use a Premium service during the preceding 12 months.

11. Indemnification

If M&G Group is sued by the State or an animal welfare association because of one of your illegal listings or reprehensible actions on the App, you agree to fully cover our legal fees and financial penalties.

12. Termination and Ban

If you do not respect the safety and welfare rules of the animal world set out here, we will close your account instantly, permanently, and without notice. We have no legal obligation to provide a service to fraudsters.

13. Applicable Law

These ToU are governed by French law. In case of a dispute that cannot be resolved amicably with M&G Group, the French courts shall have sole jurisdiction.

14. Evolution of Rules

The app evolves fast (addition of Pro subscriptions, new map features, external listing aggregation). These ToU will evolve accordingly. If you continue to use the App after a notified ToU update, you legally accept these new rules.
